These Terms of Service (“Terms”) govern your access to and use of the advertising management services and client dashboard (the “Services”) provided by Hi Dev Mobile (“Hi Dev,” “we,” or “us”). By using the Services you agree to these Terms.
1. The Services
Hi Dev provides digital advertising services, including creating and managing Google Ads accounts and campaigns on your behalf and providing a dashboard where you can view analytics and make changes to your campaigns. When we onboard you, we may create an advertising account for you under our Google Ads Manager (MCC) account.
2. Your account and authorization
- You authorize Hi Dev to access and manage your advertising accounts, including through the Google Ads API, for the purpose of providing the Services.
- You are responsible for maintaining the confidentiality of your dashboard credentials and for all activity under your account.
- You must provide accurate information and keep it up to date.
3. Google Ads program policies
Your advertising is subject to Google’s Google Ads policies. You agree not to use the Services for any content or campaign that violates those policies or applicable law, and you acknowledge that Google may disapprove ads or suspend accounts that do not comply.
4. Fees
Fees for the Services, and the handling of advertising spend billed by Google, are set out in your separate service agreement or order form with Hi Dev. [Add billing terms.]
5. Acceptable use
You may not misuse the Services, attempt to gain unauthorized access, interfere with their operation, or use them to violate the rights of others.
6. Data and privacy
Our handling of data is described in our Privacy Policy, which is incorporated into these Terms.
7. Intellectual property
The Services, including the dashboard and all related software, are owned by Hi Dev. We grant you a limited, non-exclusive, non-transferable right to use them while these Terms are in effect.
8. Disclaimers
The Services are provided “as is.” We do not guarantee any particular advertising result, ranking, or return on spend. To the fullest extent permitted by law, we disclaim all warranties not expressly stated here.
9. Limitation of liability
To the fullest extent permitted by law, Hi Dev will not be liable for indirect, incidental, or consequential damages, and our total liability is limited to the amounts you paid us for the Services in the [twelve months] preceding the claim.
10. Termination
Either party may terminate the Services as described in your service agreement. On termination we will, at your request, transfer or return control of advertising accounts where feasible.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. [Confirm jurisdiction/venue.]
